Terms of Service

These Terms of Service ("Terms") govern your use of the Bookeley mobile application (the "App") and the website at bookeley.com (the "Site"), operated by Startabas Reklam Ajansı Ticaret Limited Şirketi ("Bookeley", "we", "us").

By downloading, installing or using the App, you accept these Terms. If you do not accept them, please do not use the App.

Bookeley is a subscription service offering illustrated, narrated storybooks for children aged 3–12, with new books published regularly. Content is available in six languages: Turkish, English, Spanish, German, French and Arabic.

The App is intended for use by children, under the supervision of a parent or legal guardian.

3. Eligibility and Accounts

You must be at least 18 years old to create an account, purchase a subscription or otherwise enter into a contract with us. If you are under 18, you may use the App only with the permission and under the supervision of a parent or legal guardian.

By creating an account you confirm that you are the parent or legal guardian of the child who will use the App, and that you consent to the processing of that child's data as described in our Privacy Policy.

You may also use the App without an account. In that case your preferences are stored on your device and are not transferred if you change devices.

You are responsible for keeping your account credentials secure and for all activity carried out through your account.

4. Free Access, Subscriptions and Payment

4.1 Free access for new users

After completing onboarding, your first 3 days are free: the book of the day is free to read, and a new book is published every day, so each of those days brings a new free book — no account, no payment method and no subscription required.

You can browse the whole library at any time, before and after this period — covers, titles and descriptions are always visible — but reading the other books requires a subscription. When the 3 days end, a subscription is required to keep reading.

This free period is granted once. On devices where the App's anonymous identity survives reinstalling, reinstalling does not grant it again.

The free period does not renew and does not create any payment obligation. It is separate from the free trial described in 4.3: the free period requires no payment method, the trial does.

4.2 Subscription plans

Two plans are offered, each available on a monthly or annual basis:

Annual billing is discounted: you pay the equivalent of eight months for twelve months of access.

Current prices are always shown in the App before purchase and may vary by country.

4.3 Free trial

All paid plans include a 3-day free trial, regardless of plan or billing period.

• Starting a trial requires a valid payment method registered with your App Store or Google Play account.
• If you do not cancel at least 24 hours before the trial ends, the plan you selected will be charged automatically.
• Each user is entitled to one trial. Apple and Google determine eligibility.

4.4 How annual subscriptions are charged

Before you confirm the purchase, the App Store or Google Play will show you the exact amount and the renewal date.

4.5 Payment and renewal

• Payment is taken through the App Store or Google Play. Your card details never reach us, are never stored by us and are never visible to us.
• Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the renewal date.
• Renewal is charged to the payment method registered with your store account.
• Prices may change. We will notify you of any price increase before it takes effect, and you may cancel before it applies.

4.6 Cancellation

You may cancel at any time from your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

Deleting your Bookeley account does not cancel your subscription. These are separate operations and the subscription must be cancelled through the store. See our Support page for step-by-step instructions.

4.7 Refunds

Refunds are handled by Apple and Google under their own policies; we cannot process refunds directly. Requests should be submitted to the relevant store.

4.8 Right of withdrawal (EU/EEA and Türkiye consumers)

For digital content and services, consumer law generally provides a 14-day right of withdrawal. This right does not apply where performance has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal.

Because Bookeley grants immediate access to digital content on subscription, by completing your purchase you expressly request immediate performance and acknowledge that you thereby lose your right of withdrawal.

This does not affect your statutory rights in respect of defective or non-conforming services.

5. Content and Intellectual Property

All stories, illustrations, narration, characters, trade marks and software in the App are owned by Startabas Reklam Ajansı Ticaret Limited Şirketi or are used under licence.

You are granted a personal, non-transferable, non-exclusive and revocable licence to use the content for private, non-commercial purposes for the duration of your subscription.

You may not:

• copy, download, record, redistribute or publish the content;
• use it for commercial purposes, including public performance or classroom distribution;
• create derivative works from it;
• attempt to circumvent technical protection measures.

AI-assisted production

Content in the App is produced through an AI-assisted editorial process and is reviewed before publication. We aim for content that is age-appropriate, accurate and pedagogically sound, but we make no warranty of factual accuracy.

If you believe any content is inappropriate, please contact us at bookeley@startabas.com; we review reports promptly.

6. Acceptable Use

You agree not to:

• use the App for unlawful purposes;
• interfere with, overload or attempt to gain unauthorised access to the service;
• reverse engineer, decompile or attempt to derive the source code of the App;
• access the service through automated means (bots, scrapers);
• use another person's account or share your account credentials.

7. Availability

We aim to keep the service continuously available but do not guarantee uninterrupted access. Maintenance, updates, technical faults or events beyond our control may cause interruption.

We may modify, suspend or discontinue parts of the service. Where a change materially affects a paid subscription, we will notify you in advance and, where appropriate, offer a refund of the unused portion.

8. Termination

By you. You may delete your account at any time from Settings → Delete My Account in the App. Deletion is immediate and irreversible. Remember to cancel your subscription separately (see 4.6).

By us. We may suspend or terminate your account if you materially breach these Terms, use the service unlawfully, or attempt to harm the service or other users. Where possible we will notify you first and give you an opportunity to remedy the breach.

If we terminate your account without cause, we will refund the unused portion of your subscription.

9. Disclaimer and Liability

The App is provided "as is". To the fullest extent permitted by law, we exclude implied warranties of merchantability and fitness for a particular purpose.

We are not liable for indirect, incidental or consequential loss, loss of profit or loss of data. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect, how we use it and what rights you have.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we update the "Last updated" date above.

For material changes we will notify you in the App or by email at least 30 days in advance. If you do not accept the change, you may cancel your subscription before it takes effect. Continuing to use the App after that date constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction.

If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, nor of the right to bring proceedings in your local courts.

Turkish consumers may also apply to the Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts within the monetary limits set by law.

EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Miscellaneous

If any provision of these Terms is held invalid, the remaining provisions continue in force.

Our failure to enforce a right does not constitute a waiver of that right.

You may not transfer your rights under these Terms without our consent. We may transfer our rights in connection with a merger, acquisition or sale of assets, provided your rights are not diminished.
